NDIS Service Agreement

Terms and Conditions

The National Disability Insurance Scheme (NDIS) Service Agreement 

This Service Agreement is made to outline supports provided under the Participant’s NDIS plan. Both parties agree that this Service Agreement is made in the context of the NDIS, which aims to: 

  • Support the independence and social and economic participation of people with disability, and  

  • Enable people with a disability to exercise choice and control in the pursuit of their goals and planning and delivery of their supports. 

Supports 

A supply of supports under this Service Agreement is a supply of one or more of the reasonable and necessary supports specified in the statement included, under subsection 33(2) of the NDIS Act, in the client's NDIS Plan currently in effect under section 37 of the NDIS Act. 

Schedule of Supports 

Kinetic Balance Health agrees to provide the Participant Allied Health Services for the duration as per specified in the ‘Parties’ section of the Service Agreement document. The Provider’s pricing for supports can be found in the fee schedule. If our pricing changes during the period of the agreement, it will always be within the limits of the NDIS Schedule of Supports, and the Participant will be notified in writing at least two weeks prior to the change.  

Responsibilities of the Provider 

Kinetic Balance Health (Provider) agrees to:  

  • review the provision of supports at least annually with the Participant; 

  • once agreed, provide supports that meet the Participant's needs at the Participant's preferred times; 

  • communicate openly and honestly in a timely manner; 

  • treat the Participant with courtesy and respect; 

  • consult the Participant on decisions about how supports are provided; 

  • give the Participant information about managing any complaints or disagreements and details of Kinetic Balance Health’s cancellation policy; 

  • listen to the Participant’s feedback and resolve problems quickly; 

  • give the Participant the required notice if Kinetic Balance Health needs to end this Service Agreement (see "Ending this Service Agreement"  below for more information); 

  • protect the Participant's privacy and confidential information; 

  • provide supports in a manner consistent with all relevant laws, including the NDIS Act 2013  and Rules, and the Australian Consumer Law; 

  • keep accurate records on the supports provided to the Participant; and 

  • issue invoices and statements of the supports delivered to the Participant. 

Responsibilities of Participants / Participant’s Representative  

The Participant / Participant’s Representative agrees to:  

  • Inform the Kinetic Balance Health’s Allied Health Provider about how they wish the supports to be delivered to meet their needs;  

  • Treat the Kinetic Balance Health’s Allied Health Provider with courtesy and respect; 

  • Talk to the Kinetic Balance Health’s Allied Health Provider if they have any concerns  

about the supports being offered;  

  • Give the Kinetic Balance Health’s Allied Health Provider a minimum of eight (8) hours notice if they cannot make a scheduled appointment, and if the notice is not provided by then, Kinetic Balance Health’s Cancellation Policy will apply;  

  • Give the Kinetic Balance Health’s Allied Health Provider the required notice if they need to end the Service Agreement (see “Ending this Service Agreement” below for more information);  

  • Let the Kinetic Balance Health’s Allied Health Provider know immediately if your NDIS plan is suspended or replaced by a new NDIS plan or you stop being an NDIS Participant. 

Payments  

Kinetic Balance Health as the Provider will seek payment for their provision of supports after the supports have been delivered. 

Funding Management – Plan Management / Self-Managed  

  • If the Participant/Participant’s representative has chosen to self-manage the funding for NDIS supports provided under this Service Agreement, the Participant/Participant’s representative can choose to make payment on the day, or Kinetic Balance Health will send the Participant/Participant’s representative an invoice for those supports after they have been delivered.  

  • If the Participant/Participant’s representative has nominated a Plan Management Provider to manage the funding for supports provided under this Service Agreement, Kinetic Balance Health will claim payments for the supports from the Plan Management Provider.  

  • If there is insufficient funding in the Participant’s plan for supports provided, it is up to the Participant to find an alternative method of payment 

Changes to this Service Agreement 

If changes to the supports or their delivery are required, the Parties agree to discuss and review the Service Agreement. The Parties agree that any changes to this Service Agreement will be in writing, signed, and dated.  

You must tell Kinetic Balance Health if there is a change to your current NDIS plan: 

  • The Participant’s NDIS plan is expected to remain in effect during the period the supports are provided; and  

  • The Participant or Participant’s Representative will immediately notify Kinetic Balance Health if the Participant’s NDIS Plan is replaced by a new plan or the Participant stops being a participant in the NDIS. 

Ending this Service Agreement 

Should either Party wish to end this Service Agreement they should give 2 weeks’ notice to ensure a smooth transition away from the service. If either Party seriously breaches this Service Agreement the agreement will cease immediately.  

Cancelling Appointments and Cancellation Fees  

Regular therapy times are negotiated between you and our Allied Health Provider and it is expected that these appointment times will be kept unless sufficient notice or reason is given.  

We ask that you provide a minimum of eight (8) hours’ notice for any cancellation. If you cancel within 8 hours of your appointment there will be a cancellation fee of 50% charged to your account. If you fail to advise Kinetic Balance Health of your attendance there will be a 100% cancellation fee charged to your account. Where Kinetic Balance Health cancels a support due to operational reasons, the service will be rescheduled at no penalty to either party.

Goods and services tax (GST)  

For the purpose of GST legislation, the Parties confirm that:  

  • Kinetic Balance Health is currently registered for GST and as such will charge GST on the relevant services provided. Note: Physiotherapy services do not incur GST.

Feedback, Complaints and Disputes  

If the Participant wishes to provide Kinetic Balance Health with feedback or is not happy with the provision of supports and wishes to make a complaint, the Participant may contact Kinetic Balance Health on:
